In the event that Wedderburn Scales Limited ("Wedderburn") approves this Application for Credit, the Customer acknowledges and agrees: -
The Customer shall comply with Wedderburn's standard Terms and Conditions of Supply (
link to T&Cs on website), which the Customer confirms it has received, read and understood and shall be bound by in relation to goods presently acquired and after-acquired from Wedderburn (whether they be sold or hired).
The Credit Account is to be maintained on strictly 20th of the month following basis. Liability shall be joint and several if there is more than one Proprietor or Applicant and these conditions (including the terms) shall be binding on the proprietor’s/applicant’s successors and assigns.
A certificate signed by the Credit Manager of Wedderburn, stating the sum due and owing by the Customer at the date mentioned in the certificate shall be prima facie evidence that the sum so stated is the sum due and owing to Wedderburn by the Customer at that date.
The Customer must notify Wedderburn in writing at least 7 days prior to any intended changes in the Customer’s corporate structure, shareholding or management or any changes in the information provided in this Application.
The credit facility and account number provided to the Customer are personal to the Customer and shall not be assigned, transferred or made available by it for use by any other corporation, person or organisation and further acknowledges that any goods ordered/purchased or services provided by use of the credit facility or account number shall be paid for by the Customer.
Any expenses, costs or disbursements incurred by Wedderburn (on either a solicitor and own client basis or debt collection agency fees) in the recovery or attempted recovery of any moneys overdue on the Credit Account shall be recoverable in full from the Customer.
Wedderburn may obtain and disclose consumer credit information about the Customer and, if Wedderburn considers it relevant to assess the Customer’s application for commercial credit or to collect overdue payments in respect of that commercial credit, the Customer agrees to Wedderburn obtaining from a credit reporting agency and/or a credit provider, a credit report containing personal credit information about the Customer or its directors in relation to commercial credit provided by Wedderburn.
Wedderburn may give to and seek from any trade references or credit providers named in this Application and any credit providers that may be named in a credit report issued by a credit reporting agency information about the Customer’s credit arrangements. The Customer understands that this information can include any information about the Customer’s credit worthiness, credit standing, credit history or credit capacity that credit providers are allowed to give or receive from each other under the Privacy Act 2020. The Customer understands the information may be used for the following purposes: to assess an application by the Customer for credit; to notify other credit providers of a default by the Customer; to exchange information with other credit providers as to the status of this credit account where the Customer is indefault with other credit providers; and to assess the Customer’s credit worthiness.
